MEDIATION is a conflict resolution process in which a neutral third-party, the mediator, helps the parties reach a settlement.

ARBITRATION is a conflict resolution process in which a neutral third-party, the arbitrator, individually or along with other arbitrators, renders a decision on the dispute.

APPRAISAL is a conflict resolution process in which a neutral third-party, the umpire, along with the parties’ appraisers, reach a valuation of the insured loss.

DISPUTE RESOLUTION FEES AND PROCEDURES


Mediation, Arbitration & Umpire Fee Schedule: Unless otherwise ordered by the Court, agreed by the parties or for collection efforts, all dispute resolution fees shall be divided equally among the parties and those fees shall generally be inclusive of correspondence, consultation, research, preparation, travel and the session itself.

Half Day Session: $990.00 total ($660.00 for sessions lasting no longer than two (2) hours)
Full Day
Session: $1,980.00 total ($1,320.00 for sessions lasting no longer than five (5) hours)

For scheduling purposes half day sessions are limited to four (4) hours and full day sessions are limited to nine (9) hours. If available for use on the same day, additional session time shall be billed at the rate of $330.00 per hour.

Cancellation: There shall be no fees charged for dispute resolution sessions cancelled seven (7) days in advance of their scheduled dates. However, if dispute resolution sessions are cancelled less than seven (7) days before their scheduled dates, a $250.00 fee shall be charged for half day sessions and a $500.00 fee shall be charged for full day sessions.

Payment: Statements will generally be delivered to the parties at the conclusion of a dispute resolution session and payment is expected within fifteen (15) days of the delivery of those statements. For those parties who fail to make timely payment, the dispute resolution fee shall also include time spent in collection efforts at the rate of $330.00 per hour. Payment checks should include the Invoice # or be accompanied with a copy of the statement and should be mailed to Mark Shelton, P.A., 1539 Dale Mabry Hwy., Suite 101, Lutz, FL 33548-3008.

Dispute Resolution Summaries: Brief summaries can assist in the preparation for dispute resolution sessions. In particular, the nature of the cause of action and defenses, the liability picture, the special damages and the interests of non-parties should be included within those summaries, as well as any other information will aid Mr. Shelton in preparation for the selected method of resolution.

Even though they will be assumed to be privileged and confidential, these summaries may be exchanged and their review is generally included within the fees for the dispute resolution session. If a large number of documents or extensive summaries are expected to be reviewed, adequate time for review should be arranged and an additional fee may be charged.

 Dispute resolution summaries may be mailed to Mark Shelton, P.A., 1539 Dale Mabry Hwy., Suite 101, Lutz, FL 33548-3008, emailed to Katie@MarkSheltonPA.com or sent by facsimile to
(813) 949-6216 and should be received on or before the Friday before the scheduled dispute resolution session.


Video Conferencing: If requested ten (10) days in advance of the date scheduled for the dispute resolution session, video conferencing equipment can be made available at an additional cost.
